NCP3 is developing a four-hour course in Continuing Legal Education titled “Defending Doctors in Adversarial Proceedings.” The draft presentation covers legal principles for discrediting the hired-gun “expert witnesses” deployed by the DEA, State law enforcement, and State Medical Boards against physicians who treat pain.

A recent decision of the Fifth Circuit Court (Neumann's Pharmacy v. DEA, February 13, 2026) offers an important precedent for defending doctors in adversarial proceedings. The decision overturned a case of malicious prosecution mounted by the DEA against a pharmacist.
We invite comments from tort lawyers, doctors, and others knowledgeable in such proceedings and medical malpractice.
